2. What data we process
Depending on how you use the website, we may process information that you provide directly, such as your name, email address, phone or WhatsApp number, country, enquiry category, planned purchase timeframe and message content. We may also process technical information required to operate and secure the website, including security events and connection data.
3. Contact forms and commercial enquiries
We process information submitted through the enquiry form in order to respond to your request, prepare pricing or product information, arrange a presentation, discuss dealer cooperation or take other steps requested by you before entering into a possible contract. After submission, the website may send an automatic confirmation to the email address you provided. The legal basis is primarily Article 6(1)(b) GDPR where the processing is necessary to take steps at your request before entering into a contract and, where applicable, Article 6(1)(f) GDPR for our legitimate interest in handling business correspondence, maintaining records of enquiries and protecting legal claims.
4. Google Analytics 4
This website uses Google Analytics 4 (GA4) to understand how visitors use the website and to improve content, navigation and performance. Analytics is optional. GA4 is permitted to use analytics storage only after you choose Analytics in the cookie banner.
Depending on your device and configuration, analytics data may include online identifiers, first-party cookie identifiers, browser and device information, approximate geographic information and information about page views, sessions and interactions with the website. Ardea Yachts does not use Google Analytics to collect names, email addresses or message content from the enquiry form.
For analytics cookies and access to information stored on your device, we rely on your prior consent in accordance with Article 399 of the Polish Electronic Communications Law. To the extent analytics involves the processing of personal data, the legal basis is your consent under Article 6(1)(a) GDPR. You may withdraw that consent at any time through Cookie settings in the website footer, without affecting processing carried out before withdrawal.
Google Analytics is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. More information is available in Google's Privacy Policy and in Google's information about GA4 cookie usage.
5. Consent management and Google Consent Mode
The website uses a consent panel to let you accept, reject or customise optional technologies. The panel communicates the statistics and marketing choices through the WordPress Consent API. Google Site Kit is configured to manage Google Consent Mode v2 and maps those choices to the relevant Google consent signals. Site Kit starts the applicable optional Google storage in a denied state until consent is granted. The website stores your consent preference in your browser for up to 180 days so that it does not need to ask on every visit. You can change or withdraw the choice at any time using the Cookie settings link in the footer.
6. CAPTCHA and website security
The contact form currently uses a local arithmetic CAPTCHA and anti-spam controls. If Cloudflare Turnstile is enabled, the privacy notice will automatically reflect its use as a necessary security measure.
7. Recipients of data
Personal data may be processed by providers that support our website and business operations, including hosting, email, IT support, website security and, where you consent, analytics providers. These providers process data only to the extent necessary for the relevant service and subject to applicable contractual and legal safeguards.
8. International transfers
Some technology providers, including Google and Cloudflare, operate globally. This means that data may be processed outside the European Economic Area. Where such a transfer occurs, it should take place on the basis of a lawful transfer mechanism, such as an applicable adequacy decision or contractual safeguards required by Chapter V GDPR.
9. Retention
Enquiries submitted through the website are intended to be retained for up to 24 months unless a longer period is necessary for an active commercial relationship, a legal obligation or the establishment, exercise or defence of legal claims. Analytics data is retained according to the settings of the Google Analytics property and only for as long as necessary for the analytical purpose. Consent preferences stored in the browser expire after up to 180 days, after which the website asks for your choice again.
10. Your rights
Subject to the conditions set out in the GDPR, you may request access to your data, rectification, erasure, restriction of processing, data portability or object to processing based on legitimate interests. Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
11. Complaint to a supervisory authority
You have the right to lodge a complaint with the competent data protection supervisory authority. In Poland, this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
12. Automated decision-making
We do not use the website enquiry form to make decisions that produce legal effects or similarly significantly affect you solely by automated means.
